TERMS AND CONDITIONS
Entering the 2021 Darley Neighbourhood House and Learning Centre Christmas Tree Decorating Competition
deems acceptance of the following Terms and Conditions:
- INTRODUCTION
1.1 These Terms and Conditions govern your entry into the 2021 Darley Neighbourhood House and Learning Centre Christmas Tree Decorating Competition.
1.2 It is a requirement of submitting an application for the 2021 Darley Neighbourhood House and Learning Centre Christmas Tree Decorating Competition. that you read carefully, and agree to, these Terms and Conditions.
1.3 By submitting an application you are acknowledging that you have read, understood and accepted, and that you will be bound by all of these Terms and Conditions.
1.4 When we accept your application, we are accepting it in Bacchus Marsh, Australia. These Terms and Conditions are governed by the laws of Victoria.
- THE PROMOTER
The “Promoter’’ means the organisations that are promoting this competition, being Darley Neighbourhood House & Learning Centre
- WHO CAN ENTER
3.1 Entry is open only to all residents of the state of Victoria.
3.2 The prize winner must be able to show, upon request, adequate proof of residency and age
3.3 Entry is not available to immediate family members of staff and committee members of Darley Neighbourhood House & Learning Centre.
- HOW TO ENTER
4.1 The competition commences on Wednesday 1st of December, 2021 and concludes on Tuesday 14th of December 2021 at 9:00pm AEST (“the competition period’’)
4.2 In order to enter the competition, entrants must share a photo of their own 2021 Decorated Christmas tree on either the Darley Neighbourhood House Facebook page competition pinned post OR email to info@dnhlc.org.au
4.4 Entrants must post/send their photo by 9:00pm 14th December 2021.
4.3 Entrants may only enter the competition ONCE.
4.4 The promoter reserves the right to verify the validity of entries and reserves the right to disqualify an entrant for tampering with the entry process or for submitting an entry which is not in accordance with the Terms and Conditions.
4.5 The promoter may also share entrant information, including name and contact details, with other persons or entities that assist in running the promotion.
4.6 Incomplete entries will be deemed invalid.
- PRIZE
5.1 There will be 4 prizes
- $150 FOODWORKS voucher
- $100 BACCHUS MARSH FLORIST Christmas Arrangement
- F45 BACCHUS MARSH Membership voucher
- F45 BACCHUS MARSH Membership voucher
5.2 The prizes are not transferable.
5.3 In participating in the competition, the winner agrees to participate and cooperate as required in all marketing activities relating to the promotion, including but not limited to being interviewed and photographed. The winner grants the promoter a perpetual and nonexclusive licence to use such footage and photographs in all media worldwide and the winner will not be entitled to any fee for such use.
5.4 The prize draw will be conducted by way of a panel selection on Wednesday 15th of December 2021 before 11:59pm AEST (“Prize Draw Date”)
- CLAIMING OF PRIZE & HOW PRIZE IS AWARDED
6.1 Each entrant who has entered the competition over the competition period and registered all details in accordance with clause 4 will be eligible for the winner’s prize.
6.2 The winner will be notified by telephone and email within 24hrs of the Prize Draw Date. The winner’s name will also get published on Facebook within 14 days of the Prize Draw Date. If a prize is unclaimed, subject to any directions from a regulatory authority, the promoter may conduct a further draw on the date 7 days from the Prize Draw Date, at the same time and location as the Prize Draw, in order to distribute that Prize (Unclaimed Prize Draw)
6.3 The promoter’s decision is final and the promoter will not enter into correspondence regarding the result.
- NO LIABILITY
7.1 In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the promoter’s ability to proceed with the competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the promoter may in its absolute discretion cancel the competition and recommence it from the start on the same conditions, subject to legislation.
7.2 Darley Neighbourhood House and Learning Centre will not be liable for any misadventure, accident, injury, loss (including but not limited to consequential loss) or claim that may occur:
7.2.1 During the draw; or
7.2.2 Whilst undertaking any exercise or activity connected with their entry into the draw; or
7.2.3 in the participation in any prize; or
7.2.4 In relation to failure of any online entry message to be received by the promoter on account of technical problems or traffic congestions; or
7.2.5 Arising from or related to any problem or technical malfunction of any internet network related to or resulting from participation in this promotion; or
7.2.6 due to circumstances outside the Promoter’s reasonable control
7.3 Darley Neighbourhood House and Learning Centre and its affiliates assume no responsibility for any error, omission, interruption, deletion, defect, delays in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of, entries and reserves the right to take any action that may be available
7.4 If, for any reason, this competition is not capable of being conducted as planned, including, but not limited, due to tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the promoter which corrupt or affect the administration security, fairness, integrity or proper conduct of this competition, the promoter reserves the right, in its sole discretion, to disqualify any individual who tampers with the entry process, to take any action that may be available, and to cancel, terminate, modify or suspend the competition, subject to legislation.
